These Terms of Service ("Terms") govern your access to and use of the tools, SmartForms, and services ("Services") provided by Brand New Colors, LLC (“we”, “us”, or “our”), including all outputs, recommendations, and documents generated through our platform.

By using our Services, you agree to these Terms.

1. Use of Services

You may use our Services only in accordance with these Terms and all applicable laws. You agree not to misuse the Services or access them using any method other than the interface we provide.

2. Service Description

Our Services include the generation of personalized business documentation and strategic outputs using SmartForms and CoPilots hosted on the FormWise.AI platform and managed within our infrastructure on Go High Level . These Services may utilize the OpenAI API , meaning user inputs are sent to and processed by OpenAI's systems.

3. Ownership & Intellectual Property

All templates, prompt structures, and automation flows are the intellectual property of Brand New Colors, LLC. However, all final outputs generated using your data are yours to use as you wish.

4. Data Use & AI Outputs

By submitting data through our Services, you understand:

Your inputs may be sent to OpenAI’s API (not ChatGPT) to generate your results.While OpenAI does not train its models on this data by default, refer to OpenAI’s API Data Usage Policy for full details.Outputs are generated by AI and should be reviewed before implementation. We do not guarantee accuracy or fitness for a specific purpose.

5. Content & Review Policy

We do not review your inputs or outputs, unless:

You explicitly request support via email or contact form; You ask us to retrieve data that may have been lost on your end. All records are automatically flushed weekly on Sundays. This includes input/output logs from OpenAI and local storage.

6. Disclaimer

This is an automated tool. While we provide frameworks and structured logic, nothing we generate constitutes legal, financial, or business advice. Use at your own discretion.

7. Modifications

We may update these Terms periodically. Continued use of the Services constitutes acceptance of any updated Terms.

This Privacy Policy describes how Brand New Colors, LLC ("we", "us", or "our") collects, uses, and protects the data you share through our Services, which include tools built on FormWise.AI , powered by OpenAI's API , and managed through Go High Level infrastructure.

When using our SmartForms and CoPilots, our system automatically collects:

Your submitted responses and AI-generated outputs (text-based business data) Metadata such as timestamps. No cookies or trackers are directly implemented by us.

2. Where It Goes

Inputs are sent to OpenAI’s API for processing. Outputs are generated by OpenAI and returned through FormWise’s platform.

Important: We use OpenAI’s API , which has stricter data isolation than public ChatGPT. OpenAI states that API data is not used for model training by default.

3. Data Storage & Retention

4. Your Rights

OpenAI for AI processing
GHL for website hosting

We do not sell your data or share it with third parties for marketing purposes.

Nor do we use it to improve our products.

Its yours, we plan to keep it that way.

We use encrypted connections (HTTPS) and third-party platform security (OpenAI, FormWise, Zapier, GHL) to protect data during transmission and delivery.
